Terms and Conditions – SP Acrylics

Article 1 – Definitions
1. SP Acrylics: the sole proprietorship/business SP Acrylics, located in the Netherlands, operating under the name SP Acrylics.
2. Customer: any natural person or legal entity entering into an agreement with SP Acrylics.
3. Consumer: a customer who is a natural person and is not acting in the course of a profession or business.
4. Products: all acrylic products and Pokémon-related items offered and sold by SP Acrylics.
5. Agreement: any agreement concluded between SP Acrylics and the customer via the website or other sales channels.

Article 2 – Applicability
1. These general terms and conditions apply to all offers, orders, and agreements of SP Acrylics.
2. By placing an order, the customer agrees to these general terms and conditions.
3. Deviations from these terms are only valid if confirmed in writing by SP Acrylics.

Article 3 – Offer and Products
1. All offers on the website are non-binding, unless expressly stated otherwise.
2. SP Acrylics strives to describe and depict products as accurately as possible. Minor deviations in color, size, or finish may occur and do not entitle the customer to dissolution or compensation.
3. Pokémon-related products are fan-made and not officially licensed, unless expressly stated otherwise. SP Acrylics is not affiliated with or endorsed by The Pokémon Company.

Article 4 – Prices
1. All prices are displayed in euros and include VAT, unless otherwise stated.
2. Shipping costs will be stated separately during the ordering process.
3. SP Acrylics reserves the right to change prices. Price changes do not affect agreements already concluded.

Article 5 – Order and Formation of Agreement
1. The agreement is formed when SP Acrylics confirms the customer’s order.
2. SP Acrylics reserves the right to refuse orders or impose additional conditions.

Article 6 – Payment
1. Payment must be made in full via the offered payment methods.
2. If payment is not received, SP Acrylics has the right to cancel the order.

Article 7 – Delivery
1. SP Acrylics aims to ship orders as quickly as possible.
2. Stated delivery times are indicative and not strict deadlines.
3. SP Acrylics is not liable for delays caused by carriers or external circumstances.

Article 8 – Right of Withdrawal (for consumers only)
1. The consumer has the right to dissolve the agreement within 14 days of receiving the product without stating reasons.
2. Personalized or custom-made products are excluded from the right of withdrawal.
3. During the withdrawal period, the consumer must handle the product with care.
4. Return costs are borne by the consumer, unless otherwise agreed.

Article 9 – Returns and Refunds
1. After receiving the return shipment, SP Acrylics will refund the purchase amount within 14 days, provided the product is received in its original condition.
2. Damaged or used products may result in a partial or no refund.

Article 10 – Warranty and Complaints
1. SP Acrylics guarantees that the products comply with the agreement and the reasonable requirements of soundness.
2. Complaints must be reported in writing within a reasonable period after discovery.
3. If a complaint is justified, SP Acrylics will, at its discretion, replace the product or (partially) refund the purchase amount.

Article 11 – Liability
1. SP Acrylics is not liable for indirect damage, consequential damage, or loss of profit.
2. The liability of SP Acrylics is in all cases limited to the amount of the relevant order.

Article 12 – Force Majeure
1. SP Acrylics is not obliged to fulfill obligations if there is force majeure.
2. Force majeure is understood to mean all circumstances beyond the control of SP Acrylics that reasonably prevent fulfillment.

Article 13 – Intellectual Property
1. All designs, images, and texts on the website are the property of SP Acrylics, unless otherwise stated.
2. It is not permitted to copy, distribute, or use these without written permission.

Article 14 – Privacy
1. SP Acrylics processes personal data in accordance with applicable privacy legislation.
2. Personal data will only be used for processing orders and communicating with customers.

Article 15 – Applicable Law and Disputes
1. Dutch law applies to all agreements.
2. Disputes will be submitted to the competent court in the Netherlands.
